DHIA SERVICES (“DHIA Services,” “we,” “us,” or “our”) owns and operates this online tag ordering web site: www.eartagcentral.com (the “Website”). 3. PROTECTING YOUR PRIVACY GENERALLY. 

A.Industry-Standard Protection.  We utilize industry-standard security measures to safeguard the information we collect, maintain and use through the Website. These measures include technical and procedural steps to protect your data from misuse, unauthorised access or disclosure, loss, alteration or destruction. However, we do not guarantee the performance or adequacy of such security measures.


B.Limitation on Access.  Access to any personal information we collect and store is generally restricted to our employees and/or contractors who require it to perform a job or other contracted function. We require vendors and contractors we work with to use reasonable, industry standard protocols to maintain the confidentiality, security, and integrity of information.

7. THIRD PARTY CONTENT AND ADVERTISING SERVICES.

Third-Party Links
The Website may contain links to other websites, platforms, applications or services operated by third-parties.  These third-parties may use their own cookies, web beacons and other tracking technology to collect information about you.  They may also ask you to provide information.  This Privacy Policy does not cover those practices and we encourage you to review the privacy policies and procedures of any third-party website you use.

We may engage or work with other third-parties to serve advertisements or other analytics on the Website.

Google Analytics
We may use Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses Cookies or other tracking technologies to help us analyze how users interact with the Website, compile reports on their activity, and provide other services related to their activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a returning visitor, and any referring website. The technologies used by Google Analytics do not gather information that personally identifies you. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google’s privacy policies. Google AdWords
We may use Google AdWords for targeting and remarketing. If we do, we will collect data about your activities that does not personally or directly identify you when you visit the website, the website for which we serve advertisements, or the website and online services where we display advertisements. We use the information we collect to serve you more relevant advertisements (referred to as “Remarketing”). We collect information about where you saw the ads we serve you and what ads you clicked on. Users may opt out of Google’s use of cookies by visiting the Google Advertising Opt-out Page.


Interest-based Ads
We may use Cookies and other technologies on the Website to collect information about your online activities over time and across different websites you visit in order to provide you with interest-based advertising. You can generally opt-out of receiving interest-based advertisements from members of the Network Advertising Initiative or the Digital Advertising Alliance by visiting their opt-out pages: (http://www.networkadvertising.org/choices/) and (http://www.aboutads.info/choices/). When you opt-out using these links, please note that you may still receive advertisements. They just will not be personalized based on your interests.  

“Do Not Track” Signals
Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Website does not currently interpret, respond to or alter its practices when it receives “Do Not Track” signals.

8. SECURITY.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Website, you are responsible for keeping this password confidential.  We ask you not to share a password with anyone.  Unfortunately, the transmission of information via the internet is not completely secure.  Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk.  

9. DATA RETENTION.
We will store your information for as long as you are a customer and as long as our ethical or legal obligations require. We may keep records of transactions with you for a period of up to seven (7) years to comply with the IRS requirements.

10. NOTICE TO NEVADA RESIDENTS.
Nevada law allows Nevada residents to opt-out of the sale of certain types of personal information. Subject to a number of exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to a person for the person to license or sell the information to additional persons. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales and we will record your instructions and incorporate them in the future if our policy changes. 11. NOTICE TO CALIFORNIA RESIDENTS.
DISCLAIMER: This notice reflects our good faith understanding of the California Consumer Privacy Act (“CCPA”), California Privacy Rights Act (“CPRA”), other California privacy laws and our current data practices.  We may update our practices and this notice as the CCPA and CPRA continue to develop and we continue to develop our compliance program.  At this time, we believe that the CCPA does not apply to DHIA Services as we do not meet the statutory definition of a “business” subject to the requirements of the CCPA. Further, we do not disclose personal information obtained through the Website to third-parties for their direct marketing purposes. Accordingly, we have no obligations under California Civil Code § 1798.83.

12. NOTICE TO RESIDENTS OF THE EUROPEAN ECONOMIC AREA.  
We do not operate in the European Economic Area and do not target or market our Website to individuals in the European Economic Area. However, if you are in the EEA, you may have certain rights under the General Data Protection Regulation (“GDPR”):

If you place an order for item(s) that were mispriced, you will be notified by us in most cases. We apologize for the inconvenience. Please understand that we reserve the right to cancel any order for any reason at any time.

16. Indemnification.

You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers, attorneys, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Website.

You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Website and the Content and Materials provided therein.

20. Law, Jurisdiction And Contract Construction.

This Agreement shall be treated as though it were executed and performed in Dane County, Wisconsin, and shall be governed by and construed in accordance with the laws of the State of Wisconsin, USA (without regard to conflict of law principles).  You agree that the sole and exclusive jurisdiction for any legal proceeding, claim or action arising out of or relating to this Agreement, the Website, or the products and services offered on our Website shall be the state and federal courts located in Dane County, Wisconsin, USA.

Any cause of action by you with respect to the Website (and/or any information, documents, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

All actions shall be subject to the limitations set forth in Section 17 and Section 18, above.

The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Website is in conflict or inconsistent with this Agreement, this Agreement shall take precedence.

Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision, and our rights under this Agreement shall survive any termination of this Agreement.

21. Assignment.

This Agreement and all incorporated agreements and your information may be automatically assigned by us in our sole discretion to a third party in the event of an acquisition, sale or merger.
